Privacy Policy

1. Who we are

Emberly is a service of Relato Labs, Inc. (“we”, “us”, or “our”), a corporation organized under the laws of the State of Delaware, with its principal place of business at 2261 Market Street, 10209, San Francisco, CA 94114.

Emberly helps you remember the birthdays of people you care about and find gifts they would actually want. Today, Emberly is a waitlist: this policy describes what we collect through the Emberly website and waitlist (the “Service”), how we use it, and the choices you have. We have kept it specific to what we actually do, and we will update it before the product itself launches.

2. What we collect

What you give us. When you join the waitlist, you give us your email address.

What we record with it. Alongside your email address, we store:

Counting. We keep aggregate counters of page views. These contain no personal information.

What we do not collect. We collect no payment information, no passwords, and no accounts exist yet. We also collect no information about your friends, family, or anyone you might buy a gift for — that part of the product does not exist yet. Because Emberly’s purpose is to help you remember things about people you care about, handling information about people who are not our users carefully is the central privacy question of the product, and we will update this policy to answer it before any of that is collected.

3. How we use it

We use the information above to:

We do not sell your personal information, and we do not use it for third-party advertising.

4. Cookies and analytics

We use Google Analytics 4 (measurement ID G-HLT4RGNK63) to understand how the site is used. Google Analytics sets cookies and collects information about your device and your visit, such as pages viewed, approximate location, and device type. Our hosting provider’s web servers may also log standard technical information, such as your IP address and browser type, as part of operating the site.

You can limit analytics collection with browser settings or tools such as Google’s own opt-out browser add-on. Opt-outs generally apply only to the browser in which you set them.

5. Who we share it with

We share personal information only with the service providers who operate the Service for us:

Beyond that, we may share information if required to comply with legal process or other legal requirements; to investigate or prevent fraud, security issues, or threats to anyone’s safety; without restriction when it is aggregated or anonymized; or in connection with a significant corporate event such as a merger, acquisition, or sale of assets, including due diligence for one.

6. Your choices

To leave the waitlist, or to have the information we hold about you corrected or deleted, email us at hello@heyemberly.com. We will delete your signup record. There is no self-serve deletion mechanism yet, so email is the route — and it works.

7. Retention and security

We keep your waitlist information for as long as the waitlist is how you and Emberly are connected, and we delete it when you ask us to. We take the security of your information seriously, but no security measure eliminates all risk, and we cannot promise that ours will.

8. Information for European Territory residents

If you use the Service from the European Economic Area, Switzerland, or the United Kingdom, we ordinarily process your personal data on the basis of your consent (you chose to join the waitlist) or our legitimate interest in operating the Service.

You have the right to access, correct, update, or request deletion of your personal data; to object to or restrict our processing of it; and, where we rely on consent, to withdraw that consent at any time (which will not affect processing that happened before you withdrew it). To exercise any of these rights, email hello@heyemberly.com.

You also have the right to complain to a data protection authority. We would ask that you contact us first so we can try to resolve the issue; contact details for European data protection authorities are available from the European Data Protection Board website.

9. International transfers

The Service is operated from the United States. If you use it from outside the United States, the information described above may be transferred to and processed in the United States, where data protection laws may differ from those where you live.

10. Children

The Service is not intended for children, and we do not knowingly collect personal information from them.

11. Changes to this policy

As Emberly grows from a waitlist into a product, this policy will change. When it does, we will post the updated policy on this page with a new effective date — and where a change concerns new kinds of information, we will make the update before the collection starts, not after.
